Welcome to SMOKE KULTURE (“we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”).

Smoke Kulture is powered by Shopify, which provides the e-commerce platform that allows us to sell products to you.

By accessing, browsing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

SECTION 1 – ELIGIBILITY & AGE RESTRICTION (19+)

The Services are intended exclusively for individuals who are 19 years of age or older.

By using the Services, you represent and warrant that:

  • You are at least 19 years old

  • You have the legal capacity to enter into binding contracts

Use of the Services by anyone under the age of 19 is strictly prohibited. We reserve the right to deny access, cancel orders, or terminate accounts suspected of being used by minors.

SECTION 2 – ACCESS & ACCOUNTS

You may be required to create an account and provide accurate, current, and complete information, including billing, shipping, and payment details.

You agree that:

  • All information you provide is truthful and kept up to date

  • You are responsible for maintaining the confidentiality of your login credentials

  • You are responsible for all activity that occurs under your account

Accounts may not be sold, transferred, or shared with others.

SECTION 3 – PRODUCTS & AVAILABILITY

We make reasonable efforts to display accurate product descriptions, pricing, and images. However:

  • Product colors and appearance may vary depending on your device or screen

  • Product descriptions are provided for informational purposes only

  • We do not guarantee products will meet personal preferences or expectations

All products are subject to availability and may be changed or discontinued at any time without notice.

SECTION 4 – ORDERS & ACCEPTANCE

Placing an order constitutes an offer to purchase products from Smoke Kulture.

We reserve the right to accept, refuse, or cancel any order at our discretion, including but not limited to suspected fraud, pricing errors, or violations of these Terms.

An order is considered accepted only after payment has been successfully processed and an order confirmation has been issued.

SECTION 5 – PRICING & PAYMENT

All prices are displayed in the currency shown on the website and may change at any time without notice.

Prices do not include:

  • Applicable taxes

  • Shipping and handling fees

  • Customs, duties, or import fees (if applicable)

By placing an order, you authorize Smoke Kulture to charge your selected payment method for the full order amount.

SECTION 6 – SHIPPING & DROPSHIPPING

Smoke Kulture operates as a dropshipping retailer. Products may ship directly from third-party suppliers.

Shipping times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather conditions, or events beyond our control.

Risk of loss and title for products pass to you once the order is handed over to the shipping carrier.

SECTION 7 – NO RETURNS, NO REFUNDS (ALL SALES FINAL)

ALL SALES ARE FINAL.

Smoke Kulture does not offer returns, exchanges, cancellations, or refunds for any reason, including but not limited to:

  • Change of mind

  • Incorrect product selection

  • Product dissatisfaction

  • Shipping delays

  • Damage occurring after delivery

Once an order is placed and accepted, it cannot be canceled or modified.

Refunds or returns will only be issued where required by applicable law. By completing a purchase, you acknowledge and agree that you are purchasing products on a non-refundable, final-sale basis.

SECTION 8 – INTELLECTUAL PROPERTY

All content available on the Services, including text, images, logos, graphics, designs, and software, is owned by or licensed to Smoke Kulture and protected by intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without our prior written permission.

SECTION 9 – THIRD-PARTY TOOLS & LINKS

The Services may include links to third-party websites or tools. These are provided “as is” and “as available.”

Smoke Kulture is not responsible for third-party content, services, products, or policies and does not endorse them.

SECTION 10 – SHOPIFY PLATFORM

Our store is hosted on Shopify Inc.

All transactions are made directly with Smoke Kulture, not Shopify. You agree that Shopify is not liable for any claims, damages, or disputes arising from purchases made through our store.

SECTION 11 – USER FEEDBACK & SUBMISSIONS

Any reviews, comments, feedback, or other submissions you provide may be used by Smoke Kulture for marketing or operational purposes without compensation or obligation.

You represent that your submissions do not violate any law or third-party rights.

SECTION 12 – PROHIBITED USES

You may not use the Services to:

  • Violate any applicable law or regulation

  • Infringe intellectual property rights

  • Provide false or misleading information

  • Engage in fraud, abuse, harassment, or harmful conduct
